Divorce

We assist clients with divorce applications, including sole applications and joint applications. We can help you understand whether you are eligible to apply, what information is required, how the application is filed, and what needs to occur if there are children under 18.


A divorce legally ends the marriage, but it does not by itself resolve property settlement, parenting arrangements or financial matters. We can assist you with the divorce process itself and, where needed, advise you about the broader issues that may need to be dealt with separately.


Binding Financial Agreements

A Binding Financial Agreement can be used before, during or after a marriage or de facto relationship to record how property, financial resources and other financial matters are to be dealt with.


We can assist with preparing, reviewing and advising on Binding Financial Agreements, including agreements made in contemplation of separation or after separation has occurred. These agreements require careful drafting and independent legal advice to ensure that each party understands the effect of the agreement, the advantages and disadvantages of entering into it, and the risks involved.

  

Where the matter is suitable, we can offer fixed fees for defined stages of the process, including initial advice, review of a draft agreement, preparation of an agreement, and further amendments where required.


Financial and Property Matters

Separation often creates uncertainty about property, superannuation, liabilities, businesses, inheritances, trusts, loans, vehicles and other financial interests. We assist clients to identify the asset pool, understand their likely entitlements, and develop a practical strategy for resolving the matter.

Consent Orders

Where parties have reached agreement about property settlement or parenting arrangements, we can assist with preparing an Application for Consent Orders and the proposed orders to be filed with the Federal Circuit and Family Court of Australia.


Consent Orders can provide certainty and finality without the need for a contested court process. They are commonly used to formalise property settlements, superannuation splits, sale or transfer of property, parenting arrangements, communication arrangements, school arrangements and other practical issues.


We can assist with drafting the documents, explaining the legal effect of the proposed orders, and ensuring that the terms are clear, workable and capable of being implemented.


Financial Orders Through the Court

If agreement cannot be reached, it may be necessary to seek financial orders through the court. We assist clients to understand the court process, the documents required, and the steps involved in moving a matter toward resolution.


This may include preparing court material, assisting with disclosure, drafting evidence, attending procedural hearings, negotiating with the other party, preparing for mediation or dispute resolution, and working toward final settlement or hearing.

Parenting Matters

Parenting matters require a careful and child-focused approach. We assist parents with parenting arrangements, time arrangements, communication, parental responsibility, schooling, travel, changeovers, special occasions and other issues affecting children after separation.


Where possible, we encourage practical and cooperative solutions that reduce conflict and provide stability for children. Where agreement cannot be reached, we can assist with negotiations, parenting plans, consent orders, mediation preparation and court proceedings where necessary.
